1. OVERVIEW

This Affiliate Program Agreement (also referred to as “Agreement”, “Affiliate Agreement”, “Terms and Conditions”, “Affiliate Terms and Conditions”) is entered into by and between Don Creative Group (hereinafter referred to as “Don Creative Group”) and the Partner (also referred to as “You”, “Affiliate Partner”, “Affiliate”), and is made effective as of the date of electronic acceptance. This Agreement sets forth the terms and conditions of your participation in the Affiliate Program (the “Affiliate Program” or the “Services”). Your electronic acceptance of this Agreement signifies that you have read, understood, acknowledged, and agreed to be bound by this Agreement, along with Don Creative Group’s Universal Terms Of Service Agreement, which is incorporated herein by reference.

2. PARTICIPATION IN THE AFFILIATE PROGRAM

In order to enroll in the Affiliate Program, you need to submit your application through the affiliate signup form on the Don Creative Group website (the “Website”). All affiliate signups within 5 business days are reviewed by us before deciding if an application is accepted. If we determine that your application is not suitable for the Affiliate Program, it may be rejected for any reason.

3. YOUR RESPONSIBILITIES

As an Affiliate of Don Creative Group, you agree that:

• It is your full responsibility to provide us with accurate account information and to keep that information up to date.
• You must act in good faith and refer clients in good standing.
• You should not engage in any practices that may result in a potential revenue loss for Don Creative Group.
• You must comply with all applicable laws, including but not limited to laws on advertising.
• You should be loyal to Don Creative Group and should not misuse its confidence or damage its reputation.
• You must comply with Don Creative Group’s Third Party Code of Conduct.

4. AFFILIATE ADVERTISING

Only promotional materials approved by Don Creative Group may be used in your Affiliate Site to advertise Don Creative Group. Inappropriate ways of advertising include but are not limited to:

• The Usage of any illegal and/or spam method of advertising.
• Using Pay per Click or Pay per Impression campaigns without prior approval.
• Impersonating Don Creative Group.
• Using traffic generated by prohibited methods.
• Providing incentives to obtain sales without prior approval.
• Using our advertising materials in a manner that negatively affects our image.

5. AFFILIATE TRACKING COOKIES

We track affiliate sales automatically by using cookies. Cookies are automatically placed in the browser of the user who clicks on the affiliate link. If a previous affiliate’s cookie is already placed in the same user’s browser, it will be overwritten with the new cookie. If cookies are intentionally deleted by the user, Don Creative Group does not hold responsibility for this action.

6. AFFILIATE COMMISSIONS

Don Creative Group hosting plans, you will receive up to 5% Commission for specific products and services.

No Commission will be granted for certain products or services as outlined in our Commission structure. We retain the right to change the Commission structure and the method of calculation of the Commission at any time.

7. INFLUENCERS’ SPECIFICS

This Affiliate Agreement does not convey to You any rights of ownership in or related to Our product or technology. You must ensure that any integration complies with relevant legal regulations and properly reveals the collaboration/paid promotion fact.

8. INVOICING

We will provide you with the Commission statement due in your Affiliate Area at the start of a new month. Payout requests should be submitted by the end of the previous month. Payouts will be released by the 28th of the running month.

9. RELATIONSHIP OF THE PARTIES

Both the Affiliate and Don Creative Group agree that they are entering into this Affiliate Agreement as independent contractors and this agreement creates no partnership, agency franchise, joint venture, sales representative, or employment relationship between them.

10. ACCOUNT TERMINATION

You can cancel and terminate your affiliate account at any time by contacting us through the Affiliate Area. Don Creative Group can terminate an affiliate account with or without notice for violation of the Affiliate Program Terms and Conditions.

11. CONFIDENTIAL INFORMATION

Each party agrees to hold the other party’s Confidential Information in strict confidence and not disclose it to any third party.

12. GOVERNING LAW

Any controversy, claim, or dispute arising under this Affiliate Agreement will be resolved according to the jurisdiction and legislation where the Don Creative Group entity servicing your Affiliate account is located.

13. CHANGES TO THE AFFILIATE PROGRAM TERMS

We reserve the right to change any policies or terms of this Affiliate Agreement at any time. The amendments and/or supplements of the Agreement are effective immediately upon being posted to the Don Creative Group website.

By accepting this agreement, you acknowledge that you have read, understood, and agreed to all terms and conditions outlined herein.
